Rules governing the use of EfieOnline

1. Acceptance of Terms

Welcome to EfieOnline ("EfieOnline", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the EfieOnline website, mobile applications, and related services (collectively, the "Platform").

By accessing, browsing, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately stop using the Platform.

2. About EfieOnline

EfieOnline is an online real estate marketplace that enables property owners, developers, real estate agents, brokers, property managers, and prospective buyers or tenants to connect and engage regarding property listings.
EfieOnline is not a real estate broker, agent, property owner, financial institution, legal advisor, or party to any transaction between users unless expressly stated otherwise.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years old.
• Have the legal capacity to enter into binding agreements.
• Provide accurate and complete registration information.
• Comply with all applicable laws and regulations.

By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. User Registration and Accounts

4.1 Account Creation

Certain features require users to create an account. You agree to provide accurate, current, and complete information.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials.

• Restricting access to your account.

• All activities conducted through your account.

You must notify EfieOnline immediately if you suspect unauthorized access or security breaches.

EfieOnline may request identity verification documents, property ownership documents, business registration certificates, or other supporting information to verify users and listings.

Failure to provide requested information may result in account restrictions, suspension, or termination.

5. Property Listings

5.1 Listing Responsibilities

Users who post property listings agree that:

•They have the legal authority to advertise the property.

•All information provided is accurate and truthful.

•Property images accurately represent the property.

• Prices, availability, and property details are current.

5.2 Prohibited Listings

Users may not post:

• Fraudulent properties.

• Duplicate listings intended to manipulate search results.

• Misleading information.

• Properties that do not exist.

• Listings that violate applicable laws.

5.3 Listing Removal

EfieOnline reserves the right to remove, edit, reject, or suspend any listing without prior notice if it violates these Terms or is deemed harmful to users or the Platform.

6. Property Information Disclaimer

While we strive to maintain accurate information, EfieOnline does not verify every listing and cannot guarantee:

• Ownership claims.

• Property availability.

• Pricing accuracy.

• Property condition.

• Legal status of properties. Users are solely responsible for conducting independent verification before entering into any transaction.

7. Premium Services and Payments

7.1 Paid Features EfieOnline may offer premium services including:

• Featured listings.

• Priority placement.

• Advertising services.

• Subscription packages.

• Lead generation services.

7.2 Payment Terms
All fees are payable in advance unless otherwise stated. Payments must be made through approved payment methods available on the Platform.

7.3 Refund Policy
Payments for premium services are generally non-refundable except where required by applicable law or expressly stated otherwise. EfieOnline reserves the right to determine refund eligibility on a case-by-case basis.

7.4 Taxes
Users are responsible for any taxes, levies, duties, or governmental charges associated with their use of paid services.

8. User Conduct

Users agree not to:

• Use the Platform for unlawful purposes.

• Post false or misleading information.

• Harass, threaten, or abuse other users.

• Upload malicious software or viruses.

• Attempt unauthorized access to systems.

• Interfere with Platform operations.

• Use automated bots without authorization.

Violation may result in suspension, termination, legal action, or reporting to authorities.

9. Communications

By creating an account, you consent to receive:

• Security alerts.

• Service announcements.

• Transaction-related communications.
Users may opt out of promotional communications where permitted by law.

10. Intellectual Property

10.1 Platform Ownership All Platform content including:

• Logos

• Trademarks

• Software

• Designs

• Databases

• Text

• Graphics
remain the exclusive property of EfieOnline or its licensors. 10.2 User Content License
By uploading content, users grant EfieOnline a worldwide, non-exclusive, royalty-free license to:

• Display content.

• Promote listings.

• Market the Platform.

• Distribute and reproduce content for Platform operations. This license continues while content remains available on the Platform.

11. Reviews and User Feedback

Users may submit ratings, reviews, and feedback. EfieOnline reserves the right to remove content that:

• Is defamatory.

• Contains false allegations.

• Violates laws.

• Contains offensive language.

• Promotes illegal activities.

12. Third-Party Services

The Platform may contain links to third-party websites, services, or payment providers. EfieOnline is not responsible for:

• Third-party content.

• Third-party services.

• Payment processing errors.

• Third-party privacy practices.
Users access third-party services at their own risk.

13. Limitation of Liability

To the fullest extent permitted by law, EfieOnline shall not be liable for:

• Loss of profits.

• Loss of business opportunities.

• Property disputes.

• Fraudulent user activity.

• Inaccurate listings.

• Service interruptions.

• Data loss.

• Technical failures.

• Indirect or consequential damages.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

14. Indemnification

You agree to defend, indemnify, and hold harmless EfieOnline, its directors, employees, affiliates, partners, and agents from any claims, losses, liabilities, damages, expenses, and legal fees arising from:

• Your use of the Platform.

• Your listings or content.

• Violation of these Terms.

• Violation of applicable laws.

• Disputes with other users.

15. Suspension and Termination

EfieOnline may suspend, restrict, or terminate access to the Platform at any time for:

• Violations of these Terms.

• Fraudulent activity.

• Security concerns.

• Legal requirements.

• Conduct harmful to the Platform or its users.
Termination does not eliminate obligations incurred before termination.

16. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy.
By using the Platform, you consent to the collection, storage, processing, and use of information as described in the Privacy Policy.

17. Dispute Resolution

Users are encouraged to resolve disputes amicably.
EfieOnline is not obligated to mediate disputes between users but may provide assistance at its sole discretion.
Any disputes arising from these Terms shall be governed by the laws of the Republic of Ghana.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles.
Any legal proceedings shall be brought before the competent courts of Ghana.

19. Force Majeure

EfieOnline shall not be liable for delays or failures resulting from circumstances beyond our reasonable control, including:

• Natural disasters.

• Internet outages.

• Government actions.

• War.

• Cyberattacks.

• Telecommunications failures.

20. Changes to These Terms

EfieOnline reserves the right to modify these Terms at any time.
Updated Terms will be posted on the Platform with a revised effective date.
Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
